1. About Merch HQ

Merch HQ is a subscription-based analytics platform consisting of a Chrome extension and web dashboard. It helps Amazon Merch on Demand (AMOD) sellers track revenue, analyze pricing, and identify growth opportunities based on their own sales data.

Merch HQ is not affiliated with, endorsed by, or in any way officially connected to Amazon.com, Inc. or any of its subsidiaries. Amazon and Amazon Merch on Demand are trademarks of Amazon.com, Inc.

2. Acceptance of Terms

By accessing or using Merch HQ (including the website, Chrome extension, and dashboard), you agree to be bound by these Terms of Service. If you do not agree, do not use the service. These terms apply to all users, including free trial users.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using Merch HQ, you represent that you meet these requirements. The service is intended for sellers using Amazon Merch on Demand and is not designed for use by minors.

4. Account Registration

You are responsible for:

• Providing accurate and up-to-date account information
• Keeping your login credentials confidential
• All activity that occurs under your account
• Notifying us immediately if you suspect unauthorized access

Merch HQ does not store your Amazon credentials. The Chrome extension connects to your Amazon Merch account using your existing browser session only.

5. Subscriptions and Billing

Merch HQ offers two paid subscription plans (Starter and Pro) with a 7-day free trial for each.

• Subscriptions are billed monthly and renew automatically unless cancelled
• Payments are processed by Creem.io, our merchant of record. By subscribing, you also agree to Creem.io's terms
• If you cancel before your trial ends, you will not be charged
• You may upgrade or downgrade your plan at any time; changes take effect on the next billing cycle with prorated adjustments where applicable
• All prices are listed in EUR and exclude any taxes that may apply in your jurisdiction

We reserve the right to change pricing at any time. You will be notified of any price changes before they take effect, and continued use of the service after the change constitutes acceptance.

6. Refund Policy

Given the 7-day free trial, we generally do not offer refunds for subscription fees already charged. Refunds may be considered on a case-by-case basis for exceptional circumstances. To request a refund, contact us at hey@getmerchhq.com.

7. How the Service Works

The Merch HQ Chrome extension reads data from your Amazon Merch on Demand account pages that your browser already loads when you are logged in. It does not store your Amazon passwords, bypass security measures, or access any data beyond what is visible in your own authenticated browser session.

Sales, revenue, and pricing data from your Amazon session is processed locally in your browser and displayed to you through the extension. Merch HQ does not receive or store this data. You retain full ownership of your data.

Access to the service is controlled via a license key stored locally in your browser. When you use the extension or dashboard, your license key is verified against Creem.io's API to confirm you have an active subscription. This verification does not involve your Amazon credentials or any of your sales data.

8. Acceptable Use

You agree NOT to:

• Use the service for any unlawful purpose or in violation of Amazon's Terms of Service
• Attempt to reverse engineer, decompile, or modify the Chrome extension or dashboard
• Share your account credentials or allow third parties to access your account
• Use automated tools to scrape, copy, or extract data from the Merch HQ dashboard
• Attempt to gain unauthorized access to Merch HQ's systems or other users' data
• Resell, sublicense, or commercially exploit the service or its outputs without prior written consent

9. Informational Purpose of Analytics

All insights, recommendations, and projections provided by Merch HQ (including pricing suggestions and reprint opportunity estimates) are for informational purposes only. They are based on historical data patterns and do not constitute financial, business, or legal advice. You are solely responsible for any decisions you make based on information provided by the service.

Past performance of your listings does not guarantee future results. Revenue projections are estimates and may not reflect actual outcomes.

10. Intellectual Property

The Merch HQ platform, including the Chrome extension, dashboard, design, code, and content, is owned by Janis Wilkening and protected by intellectual property laws. Nothing in these Terms grants you any rights in the Merch HQ brand, software, or platform beyond the limited right to use the service as described.

Your sales data belongs to you. Merch HQ does not claim ownership of any data derived from your Amazon Merch account.

11. Privacy and Data

Your use of Merch HQ is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. We are committed to GDPR and Swiss FADP compliance. You may request deletion of your account data at any time by contacting hey@getmerchhq.com.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Merch HQ and its owner shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of revenue, profits, or business opportunities based on analytics or recommendations provided
• Interruptions, errors, or inaccuracies in data due to changes on the Amazon Merch platform
• Loss or corruption of your data
• Any damages arising from your violation of Amazon's Terms of Service

The service is provided "as is" and "as available" without warranties of any kind, express or implied. Our total liability to you for any claims arising from your use of the service shall not exceed the amount you paid us in the 3 months preceding the claim.

13. Service Availability and Modifications

We strive to keep Merch HQ available at all times but cannot guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the service at any time. When possible, we will provide advance notice of significant changes.

The Chrome extension's functionality depends in part on Amazon Merch on Demand's platform. If Amazon changes its platform in a way that affects our service, we will work to restore functionality but cannot guarantee timelines.

14. Termination

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period, and you retain access until then.

We may suspend or terminate your access without notice if you violate these Terms, engage in fraudulent activity, or if we determine continued access poses a risk to the platform or other users. We will make reasonable efforts to notify you of termination where legally required.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page and, for material changes, notify you by email. Continued use of the service after changes are posted constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of Switzerland, without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Switzerland.
